BVQ_34. MARITAL
What is your current legal marital status?
(Please tick one box only.)
COMMENT ON MARITAL: The aim of this variable is to measure the current 'legal' marital status of the respondent. 'Civil partnership' is a government recognized partnership without being married. The specific conditions for civil partnerships vary widely across countries. Depending on country's regulations, this includes any legal homo- or heterosexual partnerships distinct from legal marriage. In contrast, 'living as married' or 'de facto married' is no legal partnership status and therefore not of relevance to this variable. In the national survey, some guidelines in the introduction of the question shall be added to clarify what 'civil partnership' means in the respective country by using the country-specific legal term in the national language. Countries with governments that do not formally recognize legal civil partnerships can omit category 2 'Civil partnership'. Note that MARITAL must not be filtered by responses to PARTLIV. ....................................................................................................................................................................

Note:
/ AT: Code 3 'Separated from spouse/ civil partner (still legally married/ still legally in a civil partnership') not used. / AU: Code 2 'Civil Partnership' not used; civil partnerships are not relevant in the Australian context. / CH: Code 2 'Civil partnership' includes same-sex partnerships registered on federal level. / CN: One answer option was 'Cohabitation'. 80 respondents selected this answer option. Since cohabitation is no legal marital status and due to the fact that the true legal status of these respondents is not known, observations for this answer code are recoded to code -9 'Cohabit' in the integrated data file. / DE: Civil partnerships include same-sex, formally legalised partnerships (since 2000). As of 2017, marriages of same-sex couples are possible. / DK: Code 2 contains 'Registreret partnerskab' and includes same-sex partnerships (same-sex marriage became legal in 2012). / FI: Code 2 'Civil partnership' includes registered civil partnerships available for same-sex couples. / FR: Code 2 includes 'Pacsé(e)', a French contract of civil partnership (PACS). At the start, it intended to legally recognize the cohabitation of same-sex couples. In the meantime, PACS contracts are often concluded by partners of different sexes. / HR: Code 2 'Civil partnership' includes extramarital unions legally defined as living in a common household for a minimum period of 3 years and/ or joint parenthood. / IN: Original category 2 'Civil partnership' comprised 'live-in' (n=116) which is no legal status in India. These cases were recoded to category 6 'Never married' during the data preparation. In combination with PARTLIV, however, you will find 68 of the 116 cases (coded in MARITAL in the last step to code 6) in PARTLIV code 1 and 47 of the 116 cases in PARTLIV code 2. / IS: The Marriage Act has been gender-neutral in Iceland from 2010 and applies to both same-sex and opposite-sex couples. What used to be civil partnership is now considered marriage. Therefore, the Icelandic legislation has two basic structures that govern adult relationships. One is marriage and the other is registered cohabitation (Í skráðri sambúð), included in code 2. / IT: Code 2 includes same-sex unions ('Unione civile'). / JP: Code 2 'Civil partnership' not used. / MX: Code 2 includes 'Sociedad de convivencia' (same-sex marriage). / NL: The questionnaire was performed using a subsample of a long-running panel in the Netherlands called the LISS panel. This information is collected as a standard part of the LISS panel. / NO: Code 2 'Civil partnership' includes registered partner (same-sex partnership). / NZ: Answers to the original category 'De facto' (living as married) were converted to code 6 'Never married'. Category 2 includes civil unions (same-sex partners). / PH: Code 2 'Civil Partnership' not used. / PL: Code 2 'Civil partnership' not used. / RU: One answer option in MARITAL was 'Living together but unmarried', which is no legal marital status in the official sense. Such cases were recoded to code 6 'Never married' in MARITAL (in PARTLIV they are coded 1). / SI: Code 2 'Civil partnership' includes registered partnership of same-sex-couples and extramarital community (cohabitation). / SK: Code 2 'Civil partnership' not asked. / SR: Code 2 'Civil partnership' includes 'Concubinaat', which is a SR expression for 'Common-law marriage'. The answers for 'Concubinaat' come from the answer option 'Other, specify'. Common law is not based on formal laws or contracts, but rather on jurisprudence. In common law practice people can claim rights in court, if needed. Being in an common-law marriage would give partners a right to common ownership, insurance and pensions. / TW: One answer option in the national question on MARITAL was 'Cohabitation'. Respondents cohabitating needed to answer a subsequent question regarding their marital status before cohabitating, the answer to this question was used for MARITAL. / US: MARITAL now encompasses both opposite-sex and same-sex marriages. The General Social Survey (GSS) uses POSSLQ and POSSLQY (see PARTLIV) to track long-term cohabitation, but does not ask about civil partnerships separate from marriage. Hence, there are no observations for code 2 'Civil partnership' in US data. / ZA: Code 6 includes 'Never married but engaged' and 'Never married and not engaged'.
