  • BVQ_34. MARITAL

What is your current legal marital status?

COMMENT TO MARITAL: The aim of this variable is to measure the current 'legal' marital status of the respondent. 'Living as married' or 'de facto married' is no legal partnership status and therefore not of relevance to this variable. Note that MARITAL must not be filtered by responses to PARTLIV.

  • Note:
/ AT: The national questionnaire conflates the marital status categories 'Divorced' and 'Separated'. It is not possible to properly separate both categories in retrospect.
/ BG: Since living like a couple is no legal marital status, observations of the original answer category 2 'I live with a partner without marriage' has been recoded into the harmonized code 6 'Never married/ never in a civil partnership, single' during the data preparation.
/ CH: Code 2 'Civil partnership' includes same-sex partnerships registered on federal level.
/ CL: Up to 2004 there was no law regulating divorce in Chile. The legal way to end up a marriage was through a process of annulment (encoded to code 3).
/ CL: Civil partnerships are allowed in Chile since 2015 (for heterosexual partnerships and for same-sex partnerships).
/ CZ: Code 2 means 'Registered partnership' (registrovane partnerstvi), possibility to register partnerships for same-sex partners.
/ DE: Civil partnerships means same-sex, formally legalised partnerships.
/ FI: Code 2 'Civil partnership' includes registered partnerships available for same-sex couples.
/ FR: Code 2 includes 'Pacsé(e)', a French contract of civil partnership.
/ HR: Civil partnership is legally defined as living in a common household for a minimum period of 3 years and/ or joint parenthood.
/ IL: The wording used for code 2 translates as 'Living with a regular spouse with a joint life agreement'.
/ IS: Code 2 includes 'In registered cohabition'.
/ IT: Code 2 includes same-sex unions ('Unione civile').
/ LT: There is no legal civil partnership in Lithuania.
/ NO: Code 2 'Civil partnership' includes registered partner (same sex).
/ NZ: Original category 'De facto' was converted to code 6 'Never married'. Category 2 includes civil unions (same-sex partners).
/ SE: Code 2 'Civil partnership' reads 'Registered partnership' (same-sex partners).
/ SR: Code 2 'Civil partnership' includes 'Common law marriage'.
/ US: MARITAL now encompasses both opposite-sex and same-sex marriages (code 1). The US General Social Survey uses POSSLQ and POSSLQY (see note in PARTLIV for US) to track long-term cohabitation, but does not ask about civil partnerships separate from marriage (which means that code 2 is not used).
/ ZA: Previously there were not many of these types of marriages, but the common form of African marriages (Lobola) are now recognized under code 2 'Siviele Verhouding'.
